What is electronic invoicing?

The new Electronic Invoicing Act

The electronic invoice is the digital substitute for the paper invoice: it has the same legal validity, but it is issued and received in a structured format such as XML. With the new Electronic Invoicing Act, all companies and self-employed workers will be required to use it, with the aim of modernizing management, reducing defaults and improving fiscal control.

Mandatory: deadlines and stages

Electronic invoicing will be mandatory in Spain depending on the volume of billing and the publication of the regulations in the Official State Gazette:

Companies with more than 8 million annual revenues: 12 months to adapt.
Companies and freelancers with less than 8 million: 24 months.

In addition, as of July 1, 2026, all electronic invoices must be sent to the Tax Agency.

It is recommended to keep an eye on the Official State Gazette for the final deadlines.

Who will be required to issue an electronic invoice?

All companies and freelancers that carry out operations with other businesses will be required to issue electronic invoices. This obligation affects both large companies and small businesses and professionals, regardless of their size, whenever they bill other companies (B2B).

Electronic invoices must be issued with authorized software, complying with the structured formats established by the Law and with the electronic signature to guarantee their authenticity and integrity.
